These Terms of Service (“Terms”) are a binding agreement between you and Investry Analytics LLC (“Investry Analytics,” “we,” “us,” or “our”), the operator of the investment.tips website, mobile applications, and related services (collectively, the “Service”). Please read them carefully. By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms incorporate by reference our Privacy Policy and our Disclaimer & Disclosures. The Disclaimer & Disclosures page contains important information about the educational nature of the content, investment risk, and the relationship among investment.tips, Investry Analytics LLC, and Weisert Investments — please review it.

1. Who we are

investment.tips is operated by Investry Analytics LLC, in partnership with Weisert Investments, a Registered Investment Advisor whose chief strategist is Roy Weisert, Ph.D., a CFP® professional. Investry Analytics LLC operates the platform and your customer relationship; Weisert Investments is the source of the investment recommendations and educational content delivered through the Service. investment.tips is the platform; it is not itself a Registered Investment Advisor.

2. Eligibility

The Service is intended for adults age 18 and older who reside in the United States. By using the Service, you represent that you are at least 18 years old and able to form a binding contract. The Service is not directed to children under 18.

3. What the Service is — and what it is not

The Service delivers professional investment recommendations and educational content sourced from Weisert Investments. Depending on the tier and track you choose, this may include buy/sell signals, target allocations, and commentary delivered through the app, email, push notification, or SMS.

You execute your own trades. You decide whether, when, and how to act on any recommendation, and you place any trades yourself at your own brokerage. We do not access your brokerage accounts, hold your assets, manage your money, or place trades on your behalf. We have no discretionary authority over any account of yours.

Educational content, not personalized advice. The recommendations and content delivered through the Service are educational and are general in nature. They are not individualized to your financial situation, objectives, or needs, and they are not a recommendation that any particular security or strategy is suitable for you. We are not your investment advisor, broker, or fiduciary, and your use of the Service does not create an advisory or fiduciary relationship between you and Investry Analytics LLC, investment.tips, or Weisert Investments. Brokerage compatibility. The Service is designed to work at any brokerage that allows the trading cadence a given strategy requires. Brokerages such as Fidelity, Schwab, Robinhood, tastytrade, E*TRADE, and many others are examples of execution venues you might use; they are not partners of, and are not endorsed or certified by, investment.tips, and we do not guarantee that any specific brokerage will support every recommendation. You are responsible for confirming that your brokerage allows the trades you choose to make. You can confirm compatibility on our Free tier before you pay, and our 30-day money-back guarantee (§ 5) backstops paid subscriptions.

4. Your account

To use most features you must create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at support@investment.tips if you suspect unauthorized use. You may not share your account, and you may not create an account for anyone other than yourself.

5. Subscriptions, billing, and the money-back guarantee

Free tier. investment.tips offers a perpetual Free tier. You can use the Free tier to evaluate the Service — including confirming that your brokerage supports the trades you intend to make — without payment.

Paid subscriptions. Paid tiers unlock additional strategies, tracks, and features. Prices, included features, and billing cadence are presented at the point of purchase. Paid subscriptions are recurring: unless you cancel, your subscription automatically renews at the end of each billing period, and we (or the applicable app store) will charge your payment method the then-current price for the next period.

How you are billed. If you purchase through the Apple App Store or Google Play, payment is processed by Apple or Google and is also subject to that store’s terms; you manage, cancel, or request refunds for those purchases through your app-store account, as that store’s policies provide. If you purchase directly through our website, payment is processed by our payment processor, Stripe, and you manage your subscription through the Service.

30-day money-back guarantee. We offer a 30-day money-back guarantee on your initial paid subscription purchase: if you are not satisfied, request a refund within 30 days of that purchase by contacting support@investment.tips, and we will refund that payment. We do not offer a free trial. Where a purchase was made through an app store and that store controls the refund, we will help you obtain a refund consistent with this guarantee through the store’s process. Except as stated in this guarantee or as required by law, payments are non-refundable, and cancelling a subscription stops future renewals but does not refund the current period.

Cancellation. You may cancel at any time, effective at the end of the current billing period. After cancellation you retain paid access through the end of the period already paid for, then revert to the Free tier.

Price changes. We may change subscription prices or the features included in a tier. If a change affects your subscription, we will give you advance notice and an opportunity to cancel before the change takes effect; your continued subscription after the effective date constitutes acceptance of the new price or terms.

7. Intellectual property

The Service, including its software, design, text, graphics, and the recommendations, signals, allocations, commentary, and other content we provide, is owned by Investry Analytics LLC, Weisert Investments, or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your own personal, non-commercial investing. This license does not permit any use described in § 6. “investment.tips” and our logos are our trademarks; you may not use them without our prior written permission.

8. Investment risk; no warranties

Investing involves risk, including the possible loss of principal. The value of investments can go down as well as up, and past performance does not guarantee future results. No recommendation or content provided through the Service is a guarantee of any particular outcome, return, or performance.

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that recommendations or data will be accurate or delivered without delay, or that the Service will meet your requirements. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, Investry Analytics LLC, Weisert Investments, and their respective members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, investment losses, trading losses, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service or any reliance on its content, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Investry Analytics LLC, Weisert Investments, and their respective members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law, or your infringement of any third party’s rights.

The Service relies on, and may link to, third-party services — including your brokerage, app stores, payment processors, and external research or news sources. We do not control and are not responsible for those services, their availability, their content, or their terms and privacy practices. Your dealings with any third party are solely between you and that party.

12. Termination

You may stop using the Service and close your account at any time (see the Privacy Policy § 8 for how to request account deletion). We may suspend or terminate your access at any time if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Provisions that by their nature should survive termination — including §§ 7, 8, 9, 10, 13, and 14 — will survive.

13. Changes to the Service and to these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will notify you by email, in-app or website notice, or other reasonable means before the changes take effect. The “Effective date” above reflects the most recent update. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws rules, except to the extent federal law or the mandatory consumer-protection law of your state of residence applies. Before filing any formal claim, you agree to first contact us at support@investment.tips and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that is not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Arkansas, and you and we consent to personal jurisdiction and venue there, except where applicable law gives you the right to bring a claim elsewhere.

15. General

These Terms, together with the Privacy Policy and the Disclaimer & Disclosures, are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any agency, partnership, or joint venture between you and us.
